These Terms of Service ("Terms") govern your use of ClearPath AI, operated at landclearing.io ("the Service"), provided by ClearPath AI ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

ClearPath AI is an AI-powered business advisor designed specifically for land clearing and forestry mulching operators. The Service provides conversational AI guidance on topics including pricing, operations, marketing, hiring, and business growth.

2. AI Disclaimer

ClearPath AI is not a substitute for professional financial, legal, tax, or business advice. All responses generated by the Service are AI-powered suggestions based on industry patterns and the information you provide. You should consult qualified professionals before making significant business decisions.

We do not guarantee the accuracy, completeness, or applicability of any AI-generated response. You use the Service's recommendations at your own risk and sole discretion.

3. Subscription & Billing

• The Service operates on a month-to-month subscription basis.
• You may cancel at any time — your access continues through the end of your current billing cycle.
• No refunds are issued once a billing cycle has begun.
• Payment is processed through Stripe. We do not store your credit card information on our servers.

Founding 100 Rate Lock

Members who join as part of the Founding 100 program receive a locked subscription rate. This rate remains in effect as long as your subscription stays active and in good standing. If you cancel and later resubscribe, the Founding 100 rate is no longer guaranteed.

4. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate business information when creating your profile.
• One account per person/business. Sharing account access is not permitted.

5. Your Data & Business Memory

• ClearPath stores your business profile and conversation history to provide personalized AI responses ("Business Memory").
• Business Memory is tied to your account and used to improve the relevance of advice over time.
• Anonymized patterns from user interactions may be used to improve the Service and generate industry benchmarks. No individual business data is shared or identifiable in these aggregations.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract the AI model or its training data
• Resell, redistribute, or commercially exploit AI responses from the Service
• Abuse, harass, or submit harmful content through the chat interface
• Attempt to gain unauthorized access to other users' data or accounts

7. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to the Service or other users. You may also delete your account at any time by contacting us.

8. Limitation of Liability

To the maximum extent permitted by law, ClearPath AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, business losses, or decisions made based on AI-generated advice.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
